S. 2486 Veterans Benefits Improvement Act of 2004
President Bush signed into law S. 2486, the Veterans Benefits Improvement Act of 2004 on December 10th, 2004.
Though the new Act modifies and extends housing, education, and other benefits for veterans - the key portion concerning employers involves employment reinstatement and benefit rights.
The two most important aspects of this new law are these:
2) Employers must provide employees in military service the option of maintaining employer-sponsored health insurance coverage for two years.
This law applies to all employers, regardless of size - including federal, state, and local government employers.
Employees who feel their USERRA rights have been violated can go directly to court without first filing an administrative action. Employers involved in these cases face the possibility of paying back pay, attorneys' fees, and damages.
USERRA provides military leave and reemployment right for veterans and reservists; it also prohibits discrimination and retaliation based on an employee's military service.
